as an update I havent had any problems in the past 2 hours, multiple cold starts, a few halo games in there too. Sorry about my little outburst there, but microsoft does that to you. Anyway, i think my xbox should be covered by MS, the mfr date was in dec 08, so it isnt that old. So if I'm willing to go cold turkey for up to a month, I can do it for free, not including shipping!
